Business terms
These terms are the agreement between Smudge and the business that signs up for a Smudge stamp card program (“you”). They're written in plain language. By signing up, or by using the dashboard, you agree to them.
What you get
Smudge sets up and runs a digital stamp card for your business: cards your customers add to Apple Wallet or Google Wallet (or open as a web page), a counter stand with a QR code, a staff app for stamping, a dashboard with your numbers, offers to customers who agreed to get them, and a monthly report by email.
Price and payment
You pay a one-time setup fee and a monthly price, in Canadian dollars, as agreed when you sign up. Prices don't include taxes; any that apply are added. New businesses get a 30-day free trial before the first monthly payment. Payments are taken automatically by Stripe, our payment provider, from the card you add.
If you're on the founding rate, your monthly price is locked for 12 months after your free trial ends.
Price changes
We give you at least 30 days' written notice by email before your monthly price changes. If you'd rather not continue at the new price, you can cancel before it starts.
No contract, and cancelling
There's no contract: you pay month to month. You can cancel any time from your dashboard. Cancelling takes effect at the end of the period you've already paid for, and there are no refunds for partial months.
You can also delete your business from your dashboard's settings. That ends the program straight away, with no refund for the current month.
The setup fee
The setup fee is non-refundable. It covers the setup work we do with you, your card design and your counter stand.
If a payment doesn't go through
Stripe tries again over the following days. If it still hasn't gone through after 14 days, the program pauses: customers can't join or collect stamps until it's paid. Your customers keep every stamp they have, and everything turns back on as soon as the payment goes through.
Your customer list
Your customer list belongs to you. You can export it at any time from your dashboard. We handle your customers' information on your behalf, only to run your stamp card, as our privacy policy describes, and we never sell it.
When your program ends, customers' names, emails and birthday months are deleted 90 days later, or straight away if you delete your business. Anonymous numbers are kept.
Offers to your customers
Offers only go to customers who ticked the box to get them, and every offer comes from your business by name. You agree not to use Smudge to send messages customers didn't agree to, and to honour the offers you send.
No rewards for reviews
You must not use Smudge to offer rewards, discounts, stamps or anything else in exchange for reviews (on Google or anywhere else), or to ask only happy customers for reviews. Google's rules ban this, and breaking them can hurt your Google listing. Smudge won't let reward or offer text mention reviews, and Smudge may suspend any use of the service that breaks this rule.
Your part
Honour the rewards your cards show. Keep staff PINs private, and switch off staff who leave. Keep your business details accurate. Use Smudge lawfully, including Canada's anti-spam law (CASL) and privacy laws.
Keeping it running
We work to keep Smudge available and your customers' cards working, but we can't promise it will never be interrupted. Apple Wallet, Google Wallet, Stripe and other services we rely on are run by other companies. We may improve or change Smudge over time, and we'll tell you before a change that takes away something important.
Limits on our responsibility
As far as the law allows, Smudge isn't responsible for indirect losses, such as lost profits or lost business, and our total responsibility to you for any claim is limited to what you paid us in the 3 months before it.
If we need to stop
We may suspend or end your account if you break these terms (for example, the rule on reviews) or don't pay. Where we reasonably can, we'll tell you first and give you a chance to fix it. You can still export your customer list.
Changes to these terms
We may update these terms. We'll email you at least 30 days before an important change takes effect. The date below shows the latest version.
Which law applies
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
